Terms of Service

Please read these Terms of Service carefully before using MarketplaceApp. These terms govern your access to and use of our platform as a buyer, seller, or driver.
1. Acceptance of Terms
By creating an account or using MarketplaceApp (the "Platform"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Platform. We may update these terms at any time; continued use constitutes acceptance of the revised terms.
2. Eligibility
You must be at least 16 years old to create an account. By registering, you represent that all information you provide is accurate and up to date. MarketplaceApp reserves the right to suspend or terminate accounts that provide false information.
3. User Accounts
You are responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately of any unauthorized use of your account. MarketplaceApp is not liable for losses resulting from unauthorized access due to your failure to safeguard your credentials.
4. Seller Obligations
Sellers must accurately describe their products, maintain available stock, and fulfill orders in a timely manner. Sellers may not list counterfeit, illegal, or prohibited items. Repeated policy violations will result in account suspension. Sellers agree to the platform commission rate displayed in their earnings dashboard.
5. Buyer Obligations
Buyers must provide accurate delivery information and be available to receive orders. Orders that are refused without valid cause may result in account restrictions. Buyers must use the dispute process in good faith and not make fraudulent return claims.
6. Driver Obligations
Drivers must handle packages with care and deliver them to the correct address. Drivers must provide proof-of-delivery photos as requested. Failure to deliver confirmed orders without cause may result in deactivation. Drivers are independent contractors and not employees of MarketplaceApp.
7. Payments & Escrow
Payments are processed via MonCash (HTG) or credit/debit card through Stripe (USD). For MonCash payments, funds are held in escrow until the buyer confirms delivery or 72 hours have elapsed since the order was marked "delivered". Card payments are captured immediately at checkout. MarketplaceApp deducts a platform commission before releasing seller payouts.
8. Returns & Refunds
Buyers may request a return within 48 hours of delivery for items that are damaged, incorrect, or materially not as described. MarketplaceApp will mediate disputes between buyers and sellers. Refunds for eligible claims are processed within 5 business days. Perishable goods and digital items are non-refundable.
9. Prohibited Conduct
Users may not: (a) list illegal goods or services; (b) manipulate reviews or ratings; (c) circumvent the platform to conduct off-platform transactions; (d) harass other users; (e) use automated tools to scrape or abuse the platform; or (f) attempt to gain unauthorized access to other accounts or systems.
10. Intellectual Property
All content on the Platform — including logos, design, and software — is the property of MarketplaceApp or its licensors. Users retain ownership of content they upload (product photos, descriptions) but grant MarketplaceApp a non-exclusive license to display that content on the Platform.
11. Limitation of Liability
MarketplaceApp acts as an intermediary between buyers and sellers and is not liable for the quality, safety, or legality of listed products. To the maximum extent permitted by law, our liability is limited to the transaction value of the order in question.
12. Governing Law
These terms are governed by the laws of the Republic of Haiti. Any disputes shall be resolved through good-faith negotiation, and if unresolved, through binding arbitration in Port-au-Prince, Haiti.
